Both firearms used in the road rage shooting that killed Faisal ul Rehman in Emmarentia at the weekend were legally licensed, Gauteng police said.
Police spokesperson Dimakatso Nevhuhulwi told IOL that both weapons allegedly used by the 58-year-old shooter and the firearm retrieved by Rehman's wife, Tehseen, were legally held.
"Both firearms are licensed," Nevhuhulwi said, adding that Rehman's firearm was registered in his name.
Rehman, 48, was killed on Sunday afternoon after a minor collision between two vehicles on Barry Hertzog Avenue escalated into a physical fight between the two drivers.
According to police, Tehseen then retrieved a firearm, prompting the other motorist, who was also armed, to open fire.
Dashcam footage of the incident, which emerged on Wednesday, showed the two men locked in a physical fight before shots were fired.
Rehman was gunned down in full view of his two young children.
Tehseen was shot in the hand and shoulder. She survived and remains in hospital.
A 58-year-old man was arrested at the scene but the NPA announced that it would not prosecute him pending further investigation.
His legal team has argued he acted in self-defence.
Rehman's nephew, Muhammad Wasi Haider, rejected that claim and said the family would pursue the case.
"Faisal did not point the firearm at him and start shooting," Haider said. "That person could have avoided killing Faisal ... he shot to kill him."
Haider said his uncle had always carried a firearm because of the nature of his work as a car dealer, but doubted he had ever even fired it.
"He just had it for safety reasons because of the business that we do," Haider said.
Throngs of mourners gathered at Westpark Cemetery in Johannesburg on Tuesday night to pray over Rehman's body.
His remains are now expected to be taken to Pakistan for burial.
